Relocation of telephone mast

We acted for a major telecoms operator in connection with long-running negotiations regarding the relocation of a core telephone mast located in the vicinity of a proposed mining operation.  We conducted an initial detailed investigation into the mineral and mining rights granted historically and provided advice on complex issues connected with the overlap between telecoms regulation and the Mines and Minerals Act.

We negotiated a detailed settlement agreement, involving land transfers and leases including issues arising from the statutory protection under the Telecoms Code.

This was a highly complex and specialist area of property litigation work that we were ideally placed to advise on, having one of the key telecoms specialists in the region and a strong telecoms practice nationally.
