            Martyna Wurm

            Senior Associate

            Martyna is an attorney-at-law and a competition and consumer law expert who supports Clients in wide variety of issues concerning competition rules and consumer rights. 

            Martyna is an Senior Associate at DWF Poland and a member of the antitrust and competition practice. She practices in the area of Polish and EU competition law, including anti-competitive agreements, abuse of dominant market position, merger control and state aid. 

            She specialises also in consumer protection law, advising business entities on their compliance with consumer rights, especially in terms of process of offering and selling products or services and standard contracts and general terms used in relations with consumers. 

            In her competition and consumer law practice she focuses on representing clients before courts and the President of UOKiK, as well as preparing compliance programs and internal manuals and conducting training for employees and managers. In her practice she also uses her knowledge of finance and economics, which enables her effective application of competition law regulations in the financial sector as well as in transactions and in merger clearance proceedings.

            Competition Law 

            • Advising a leading company operating on gas and oil sector in a precedent antirust proceedings before the President of UOKiK alleging participation in a cartel of price fixing, market sharing and bid rigging on the Warsaw heat market (pending). 
            • Advising a leading bicycle and sports equipment distributor in Poland in antimonopoly proceedings alleging price-fixing (case won before the Court of Appeal in Warsaw – the judgement is final and payable). 
            • Advising leading EU printing machines manufacturers on multijurisdictional antimonopoly proceedings before the President of the Office of Competition and Consumer Protection (UOKIK) and Bundeskartellamt on obtaining consent to establish a joint undertaking (JV) active on digital printing market (unconditional consent). 

            Consumer protection law 

            • Advising a leading insurance institution in Poland in preparation and implementation of complex consumer law compliance program including creation of the financial products (i.e. life insurance with insurance capital fund), the organization and planning of the sale of products for consumers, as well as advertising and promotion of those products. 
            • Advising a financial institution on the compliance of standard contracts and general terms with consumer protection law. 
            • Advising a client on the preparation and implementation of a loyalty scheme designed for businesses from the energy sector offering as one of the benefit the insurance package.
