The breakout session will look at how to hold an 'off the record' discussion. The recent decision by the EAT in the case of Faithorn Farrell Timms LLP v Bailey considered the protection afforded to employers when having an 'off the record' discussion with an employee. During this breakout session we will consider how employers can engage in confidential, frank discussions with employees concerning exit negotiations and parting ways on mutually agreeable terms. Delegates will be given the opportunity to work through case studies and share experience on the above issues.
