NEC4 - What has changed?

Seminar Series - September 2017

Following the recent publication of the new NEC4 suite of contracts, DWF are hosting a series of seminars across the UK to consider these agreements and how they have evolved from NEC3 2013.

Paul Barge will examine key changes to the main forms and professional services contract together with associated issues that users of NEC4 will need to be aware of.

Points to be covered include:

The Two New Forms of Contract

  • An overview of the main features of the Design Build & Operate and Alliancing forms (the latter issued initially for consultation)

New Terminology

  • Language changes such as redefinitions of Employer, Works Information/Service Information and Risk Register

Changes to the Core Clauses

  • Revisions to the interim payment mechanism and the new final assessment procedure
  • The application of 'deemed acceptance' provisions to cover the submission of programmes
  • Additional Compensation Events and amendments to the implementation provisions
  • Defined Cost changes such as the introduction of assessment and 'deemed acceptance' provisions and more restricted use of the Shorter Schedule of Cost Components
  • The introduction of a single fee percentage
  • Contractor's proposals to allow for works reduction and cost saving
  • New clauses covering assignment, bribery/corruption, confidentiality and quality management

'W' and Secondary Options

  • Changes to the W1 and W2 dispute provisions and a new W3 dispute resolution procedure
  • An amended company guarantee clause
  • Introduction of a 'BIM' option
  • An undertakings (collateral warranty/third party rights) clause
  • A transfer of rights provision
  • Changes to the contractor's design liability and associated burden of proof

  • Updated 'Construction Act' Y(UK)2 provisions to tie in with the changes to the core payment clauses
