Costs Management Orders: first instance decisions or appellate court issues?

There have been two recent appeal decisions in relation to costs management orders. InRedfern v Corby Borough Council (2014) and Havenga v Gateshead NHS Foundation Trust & Anor (2014) the claimants had asked the High Court to overturn the decisions of the lower court which had significantly curtailed their costs budgets.
