The Advocate General has given his opinion in the Woolworth’s case that ‘establishment’ means “the unit to which the workers made redundant are assigned to carry out their duties”.
This is good news for employers, however, the Advocate General has said that there is nothing to stop the courts from implementing rules which are more favourable to employees.
