Trading Standards refer ‘health claims’ for ASA judgement

In an almost unprecedented case, the Advertising Standards Authority has upheld complaints concerning a range of health claims by ‘Protein World’ following a complaint by Northamptonshire Trading Standards. It is of concern that a public body with a legal duty to enforce the relevant legislation should act in this way passing matters of legal and technical interpretation investigation by a lay body. It was even left to ASA to pronounce on whether ‘Raspberry Ketone’ is to be regarded as a ‘novel food’ under EU law.
